Contract for Photography Services

This Contract (“Contract”) is entered into by [Anaris Visuals] (“Business Name”), [Aina Falola] (“Photographer”) and [ (“Client”). It outlines the terms and conditions for photography services to be provided by Photographer to the Client.

Services

The Photographer will provide the following photography services to the Client:

[List of services to be provided, such as:

Photography session at photographer studio or at a location of the Client’s choice
Editing and retouching of select images
Deliver via WeTransfer or Google Drive

Fees and Payment

The Client will pay a non-refundable retainer fee of £50 at the time of booking to secure the session date and time. The remaining balance is due on or before the day of the session.

Cancellation and Rescheduling

The Client may cancel or request to reschedule the session up to 48 hours prior to the scheduled start time. If cancellation or rescheduling occurs within 48 hours of the session, the retainer fee will be forfeited and is non-refundable.

Copyright and Reproduction

The copyright of all images produced during the session remains with the Photographer. The Client is granted a limited license to use the images for personal, non-commercial use, including printing and sharing on social media. The Client may not sell or publish the images without the written permission of the Photographer.

Model Release

Client grants the Photographer and its legal representatives the irrevocable and unrestricted right to use and publish photographs of Client, or in which Client may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client releases all claims to profits that may arise from using images.

If the Client does not wish to grant this permission, a written request must be submitted before the shoot, and an additional privacy fee may apply.

Liability

The Photographer is not responsible for any injuries sustained by the Client or for any loss or damage to the Client’s personal property during and after the session. In the rare case of equipment failure, corrupted files, or other unforeseen circumstances, the Photographer’s liability is limited to either rescheduling the session at no additional cost or issuing a full refund of the amount paid for the session.

Extra Fees

In addition to the fees outlined in Section 2, the following extra fees may apply:

Partner or Child not pre-agreed in advance but included during the session incurs [£20] fee
Travel fees: If the session takes place outside of the Photographer’s studio, an additional travel fee may apply. For locations requiring significant travel time or overnight accommodation, any related transportation and/or accommodation costs will be discussed and agreed upon in advance before confirmation of the booking.
Additional digital images: If the Client requests additional digital images beyond the number included in the total fee, the cost will be [£15] per image.
Additional editing and retouching: If the Client requests additional editing and retouching beyond the number included in the total fee, the cost will be [£15] per image.
Additional usage rights: If the Client wishes to use the images for commercial purposes or to publish the images, an additional fee may apply. The cost will be negotiated on a case-by-case basis.

Any extra fees must be agreed upon in writing and paid in full before the additional services are provided.

Post-Production and Editing

The Photographer will edit and retouch a selection of images from the session to be included in the final gallery.

The Client may request additional editing and retouching of images beyond the number included in the total fee for an additional fee (as outlined in Section 7: Extra Fees). The additional editing and retouching cost is [£15] per image.

The Photographer will use their professional judgment to select the images that will be edited and retouched. However, the Client may request specific images to be edited or excluded. Any such requests must be made in writing and received by the Photographer within [3] days of receiving the initial gallery. The Photographer will make reasonable efforts to accommodate the Client’s requests but cannot guarantee that all requests can be fulfilled.

The edited images will be delivered to the Client via a WeTransfer/Google Drive within [7-14] days after the Client has selected their images from the session if no additional editing is requested. The Client will have [2] days to review the edited images and request further revisions. Any additional revisions requested by the Client will be subject to additional fees.

The final edited images will be delivered to the Client in high-resolution digital format, with printing rights granted to the Client for personal, non-commercial use. The Client may not sell or publish the edited images without the written permission of the Photographer.

Ownership and Usage Rights

The copyright of all images produced during the session remains with the Photographer. The Photographer retains all rights to the images, including the right to reproduce, publish, and sell the images.

The Client is granted a limited license to use the images for personal, non-commercial use. This includes printing the images for personal use and sharing the images on social media. The Client may not sell or publish the images without the written permission of the Photographer.

If the Client wishes to use the images for commercial purposes or to publish the images, an additional fee may apply. The cost and terms of the usage rights will be negotiated case-by-case.

By signing this Contract, the Client agrees to the terms and conditions outlined in this section and understands that they do not own the copyright to the images and are not entitled to sell or publish the images without the written permission of the Photographer.

Photographer Exclusivity

Client agrees to hire the Photographer for all photography services for the duration of this Contract. The Client will not hire or engage other photographers for the same purpose during this time.

If Client breaches this exclusivity clause, Client will pay the Photographer a fee of [£100] as liquidated damages. This fee is not intended as a penalty but as a reasonable estimate of the Photographer’s damages in the event of a breach.

This exclusivity clause does not apply to photographs taken by the Client or by the Client’s guests or employees for personal use.

By signing this Contract, the Client agrees to the terms and conditions outlined in this section and understands that they are not permitted to hire or engage any other photographers for the same purpose during the duration of this Contract.

Cancellation, Refund, and Rescheduling Policy

The Client may cancel or reschedule the session at any time up to 48 hours before the scheduled session time. If the Client cancels or reschedules within 48 hours of the session, the retainer fee will not be refunded.

Suppose the Photographer is unable to perform the session due to illness, emergency, or other unforeseen circumstances. In that case, the Photographer will notify the Client as soon as possible and offer to reschedule the session at a mutually convenient time. If the session cannot be rescheduled, the Photographer will refund the retainer fee to the Client.

If the Client cancels the session after the retainer fee has been paid, the retainer fee will not be refunded. If the Client cancels the session after the final balance has been paid, the final balance will not be refunded.

By signing this Contract, the Client agrees to the terms and conditions outlined in this section and understands that the retainer fee and final balance are non-refundable under most circumstances.

Raw/Unedited Images

Raw/Unedited files are not included in any standard package and remain the exclusive property of the Photographer. If the Client wishes to request for the raw files, a written request must be submitted before the shoot, and an additional fee may apply on a case-by-case basis.

If the raw files are released to the Client at their request:

All RAW files remain the intellectual property of [Anaris Visuals]. They are provided “as-is”, with no editing, color correction, or retouching.
Clients are granted personal use license only, non-commercial use unless otherwise agreed in writing.
They may not be publicly shared, published or used in any way that may misrepresent or negatively impact the Photographer’s brand.
Use of unedited images is not permitted to critique or reflect upon the Photographer’s quality or service.
If a third-party is editing or another photographer is used, the original Photographer [Anaris Visuals] must not be credited, tagged, or associated with the altered image.
The edited images cannot be branded, watermarked or claimed by the third-party photographer.

Governing Law

This Contract shall be governed by and construed in accordance with the laws of the State of [United Kingdom/Scotland].

Entire Agreement

This Contract constitutes the entire agreement between Photographer and Client.
